These terms apply when you use shipanysaas.com and its live demos, and when you buy the shipanysaas starter kit. By using the site or buying the kit, you agree to them.
Who we are
shipanysaas is sold by Dataspecc LLC ("we", "us"), 2055 Limestone Road, Wilmington, DE 19808, United States. You can reach us through our contact page or at buildwitholga@gmail.com. Your card statement shows the charge as SHIPANYSAAS.
What you buy
The kit is source code: a starter kit for building SaaS products, sold in two plans. Starter covers the web app. All-in adds the iPhone, iPad and Android app. What each plan contains is described on our pricing page at the time you buy.
You get read access to the private GitHub repository for your plan, and the updates we publish there. What you may do with the code is set by the licence in the repository's LICENSE file, which forms part of these terms; where the two differ about using the code, the licence applies. In short: you can build as many products as you like for yourself or your clients, but you may not resell, share or publish the kit's source code, or use it to make another starter kit or template.
Prices and payment
Prices are shown in US dollars and paid once. There is no subscription. The price at checkout is the total you pay: we don't add sales tax or VAT. Launch prices are for a limited number of early purchases and can end at any time. Payments are processed by Stripe.
Delivery
At checkout you enter your GitHub username. We invite that account to the repository, usually within minutes, and GitHub and we email you. Your access starts when you accept the invitation. Use a personal GitHub account, not an organization. Invitations expire after 7 days: if yours does, if you entered the wrong username, or if no invite arrives within 10 minutes, contact us with the email address you used to pay.
The All-in upgrade can only be delivered to a GitHub account that already has Starter access.
No refunds
Your access starts as soon as we send your GitHub invitation, so all sales are final and we don't offer refunds. We will refund you if we cannot deliver what you paid for (for example, an All-in upgrade bought for an account without Starter access), if you were charged twice by mistake, or where the law requires it.
If you are a consumer in the EU, the EEA or the UK: by completing your purchase, you ask us to give you access to the digital content straight away, and you acknowledge that you lose your 14-day right of withdrawal once that access begins.
If a payment is fully refunded, or you open a chargeback, your access to the repository and its updates ends, and so does your licence. If a chargeback is decided in our favour, contact us and we will restore your access.
Updates
Your plan includes the updates we publish for it, with no renewal fee. We decide what to publish and when, and we don't promise any particular update or schedule. Each update comes under the version of the licence included with it.
Using the site and the demos
Don't misuse the site: no attacks, no attempts to reach other people's data or accounts, no automated access that harms the site, and nothing illegal. The live demos share one account and reset every hour, so don't enter real personal data there. If you create an account on the site, keep your sign-in details safe; you are responsible for what happens under your account.
Other services
The kit is built to run on services such as Supabase, Stripe and Vercel. To run your own products you need your own accounts with them, under their terms and prices.
No warranty
The kit and the site are provided "as is" and "as available", without warranties of any kind, to the extent the law allows. You are responsible for the products you build with the kit, including their security and their compliance with the laws that apply to them.
Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, data or business. Our total liability to you is limited to the amount you paid us. Nothing in these terms limits liability that the law does not allow to be limited, or your mandatory rights as a consumer.
Ending access
We may suspend or end your access if you break these terms or the licence. For breaches of the licence, the rules in the LICENSE file apply, including your chance to fix a breach where the licence gives one.
Changes to these terms
We may update these terms. Changes apply from the date at the top of this page, and they don't change the terms of a purchase you have already made.
Governing law
These terms are governed by the laws of the State of Delaware, United States. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim there.
